Governing Law: Ecuador

1. Introduction & Acceptance of Terms

These Terms & Conditions, together with our Privacy Policy and applicable expedition-specific booking documents, govern the services offered by KAIJU S.A.S., operating as KAIJU Expeditions (“KAIJU,” “we,” “our,” or “us”).

Our expeditions are promoted through www.danabjarner.com.

Guests must review and accept these Terms & Conditions before confirming their reservation. A booking is confirmed only after KAIJU approves the reservation and receives the required payment.

By confirming a booking, guests agree to the applicable booking conditions, cancellation policies, participation requirements, and safety guidelines, subject to their rights under applicable law.

A Spanish-language version of these Terms & Conditions will be made available. In the event of any discrepancy between language versions, interpretation will be subject to applicable law and mandatory consumer protections.

Each guest will receive confirmation of their agreed booking price, payment deadlines, included services, and applicable cancellation conditions.

For expeditions organized in collaboration with other companies, booking and payment conditions may differ. Please refer to Section 15 for details.

2. Booking Requirements & Participation

KAIJU organizes small-group expeditions in collaboration with independent local providers, including accommodations, boat operators, guides, and transportation services.

All participants must be 18 years of age or older and meet the swimming, fitness, health, and experience requirements specified for their expedition.

Guests may be required to provide:

  • Relevant medical information or medical clearance when necessary for safe participation.
  • Signed participation and risk acknowledgment forms.
  • Valid travel documentation, insurance details, and required permits.
  • Additional documentation reasonably required by KAIJU or local authorities.

Medical Clearance

If medical clearance or other required documentation is requested, guests must provide it by the communicated deadline.

Failure to meet these requirements may result in cancellation of the reservation. The standard Cancellation & Refund Policy will apply based on the date KAIJU is notified or the deadline passes, subject to applicable law.

Guests are responsible for ensuring they are physically and medically prepared for their expedition.

TERMS & CONDITIONS ACKNOWLEDGMENT

KAIJU may send these Terms & Conditions to participants via email for review and signature before departure. All participants are required to review, acknowledge, and sign the agreement when requested.

Failure to submit the signed agreement by the communicated deadline may affect the guest's eligibility to participate in the expedition, subject to applicable law.

3. Reservations, Deposits & Payments

All reservations are subject to availability and KAIJU's approval.

A booking is confirmed once the required payment has been received and accepted.

Galápagos Expeditions

  • 50% non-refundable deposit to secure a reservation.
  • Remaining balance due 60 days before departure.

French Polynesia Expeditions

  • 30% non-refundable deposit to secure a reservation.
  • Remaining balance due 120 days before departure.

Last-Minute Bookings

Reservations made after the applicable final payment deadline require full payment to confirm the booking.

The agreed booking price, including applicable discounts or additional fees, payment deadlines, and services included will be communicated before payment and confirmed in writing.

Failure to complete payment by the required deadline may result in cancellation after notice and a reasonable opportunity to resolve the outstanding balance. The applicable cancellation terms will apply.

Prices may change before booking confirmation. Once confirmed, the agreed price will apply, subject to any expressly disclosed adjustments permitted by law.

All payment and cancellation conditions remain subject to applicable consumer protection laws, including any mandatory withdrawal or refund rights.

4. Guest Cancellations & Refunds - Detailed

Due to limited group sizes and advance financial commitments to local partners, deposits are non-refundable under the standard guest cancellation policy, subject to applicable law and the exceptions stated in these Terms & Conditions.

If a guest cancels without an approved replacement, the following refund schedules apply.

4.1 Galápagos Expeditions

Standard expedition price: USD $3,600

Non-refundable deposit (50%): $1,800

Remaining balance: $1,800

Final payment deadline: 60 days before departure

Cancellation Refund Schedule

  • 61 days or more before departure: Refund of 100% of the agreed booking price, excluding the non-refundable deposit.
  • 31–60 days before departure: Refund of 50% of the agreed booking price, excluding the non-refundable deposit.
  • 30 days or less before departure: No refunds under the standard guest cancellation policy.

Example — Galápagos:

A guest who has paid the full $3,600 expedition price and cancels 45 days before departure would receive a $900 refund:

Total expedition price: $3,600

Non-refundable deposit: $1,800

Refundable portion: $1,800

Applicable refund percentage: 50%

Refund: $900

If the same guest cancels 60 days or more before departure, they would receive $1,800, representing the full amount beyond their non-refundable deposit.

4.2 French Polynesia Expeditions

  • Standard expedition price: USD $5,750
  • Non-refundable deposit (30%): $1,725
  • Remaining balance: $4,025
  • Final payment deadline: 120 days before departure

Cancellation Refund Schedule

  • 121 days or more before departure: Refund of 100% of the agreed booking price, excluding the non-refundable deposit.
  • 91–120 days before departure: Refund of 50% of the agreed booking price, excluding the non-refundable deposit.
  • 90 days or less before departure: No refunds under the standard guest cancellation policy.

Example — French Polynesia:

A guest who has paid the full $5,750 expedition price and cancels 110 days before departure would receive a $2,012.50 refund:

Total expedition price: $5,750

Non-refundable deposit: $1,725

Refundable portion: $4,025

Applicable refund percentage: 50%

Refund: $2,012.50

If the same guest cancels 121 days or more before departure, they would receive $4,025, representing the full amount beyond their non-refundable deposit.

4.3 How Refunds Are Calculated

The following conditions apply to both destinations:

  • The non-refundable deposit is excluded from all standard cancellation refunds.
  • Refund percentages (100%, 50%, or 0%) are calculated based on the total agreed booking price after deducting the non-refundable deposit.
  • The agreed booking price includes any applicable discounts or additional fees.
  • Refunds cannot exceed the amount actually paid by the guest beyond their non-refundable deposit.
  • Refunds requiring international bank transfers will be subject to applicable transfer fees, including any intermediary bank charges. These fees will be deducted from the refund amount, and the guest will receive the remaining balance.
  • Guests who have paid only their deposit are not eligible for a refund under the standard cancellation schedule.

These calculations are subject to the amount actually paid, the exceptions stated in these Terms & Conditions, and mandatory legal rights.

Cancellation Requests

Guests must communicate cancellation requests to KAIJU in writing. The cancellation date will be the date KAIJU receives the written request.

Nothing in this section limits any withdrawal, refund, or other consumer rights that cannot legally be excluded.

5. Replacement Participants & Date Changes

If a guest can no longer attend, they may propose a replacement participant, subject to KAIJU's approval.

The replacement must meet all participation requirements, accept the booking conditions, and complete the necessary payments.

Full Refund Through Replacement

If an approved replacement secures and pays for the reservation within the following deadlines, the original guest may receive a full refund, including their deposit:

  • Galápagos: 61 days or more before departure.
  • French Polynesia: 181 days or more before departure.

Eligibility is determined by the date the replacement's booking and required payment are confirmed, not solely by the date the original guest requests cancellation.

Replacements After These Deadlines

Replacements may still be accepted closer to departure. However, refunds may be reduced by reasonable, documented, non-recoverable costs or additional fees directly resulting from the cancellation or replacement.

Any deductions will be explained to the original guest. Costs already recovered through the replacement booking will not be charged again.

Refunds cannot exceed the amount originally paid by the guest.

Until the replacement is confirmed and payment is received, the original guest remains subject to the standard Cancellation & Refund Policy.

Changing Expedition Dates

Guests may request to transfer their booking to another expedition date, subject to availability and KAIJU's approval.

Date changes are not guaranteed and may involve additional costs, non-recoverable supplier commitments, or price differences.

If a transfer cannot be arranged and the guest chooses to cancel, the standard Cancellation & Refund Policy applies.

All arrangements remain subject to applicable law.

6. Itinerary Changes, Weather & Wildlife Encounters

Nature-based travel requires flexibility.

KAIJU and our local partners may modify, reschedule, substitute, or cancel individual activities due to weather, ocean conditions, wildlife behavior, conservation regulations, safety concerns, transportation disruptions, or circumstances beyond our reasonable control.

No specific wildlife encounter, location, activity, or itinerary element can be guaranteed.

We will make reasonable efforts to provide suitable alternatives whenever possible.

No-Shows, Late Arrivals & Unused Services

No-shows, late arrivals, early departures, or voluntarily choosing not to participate in included activities do not entitle guests to partial refunds or credits under the standard booking conditions, subject to applicable law.

Guests are responsible for additional costs resulting from changes to their personal travel arrangements.

If an included activity cannot proceed, any applicable refund, credit, or alternative will be assessed according to the circumstances, services delivered, contractual obligations, and applicable legal requirements.

7. Expedition Cancellation by KAIJU & Extraordinary Circumstances

Unexpected circumstances, including severe weather, natural disasters, travel restrictions, or emergencies, may affect travel plans.

  • If a guest cancels: The standard Guest Cancellation & Refund Policy applies, subject to applicable law.
  • If KAIJU cancels an expedition: Guests will receive a full refund of all payments made to KAIJU, including deposits, if the cancellation is due to insufficient participants or other reasons within KAIJU's control.
  • If an expedition is cancelled due to extraordinary circumstances beyond our reasonable control: KAIJU will communicate available options, including rescheduling, credits, or refunds, based on the circumstances and applicable law.

Affected guests will be notified as soon as reasonably possible.

8. Health, Safety & Guest Conduct

Guests must follow all safety instructions provided by KAIJU and authorized local guides.

KAIJU reserves the right to restrict or discontinue participation when reasonably necessary due to:

  • Unsafe behavior or failure to follow safety instructions.
  • Harassment, discrimination, or inappropriate conduct.
  • Medical or wellbeing concerns affecting safe participation.
  • Actions that endanger other guests, staff, wildlife, or the environment.

Where removal is reasonably justified by a guest's conduct, unused services are generally non-refundable, subject to applicable law.

Guests are responsible for their personal medications, required vaccinations, and relevant medical arrangements.

Medical assistance and emergency evacuation may be limited, delayed, or costly in remote destinations.

9. Travel Insurance

Comprehensive travel insurance is mandatory for all KAIJU expeditions.

Guests must obtain appropriate coverage for their destination and planned activities, including:

  • Emergency medical treatment, evacuation, and repatriation.
  • Trip cancellation and interruption.
  • Travel delays and lost baggage.
  • Snorkeling, freediving, and other applicable activities.

Guests must ensure their policy provides sufficient coverage and understand any exclusions, including those relating to extraordinary circumstances.

KAIJU may request proof of insurance before departure.

10. Third-Party Providers & Additional Expenses

KAIJU works with independent local providers who may require advance, non-refundable payments for accommodations, boats, transportation, permits, and other services.

These commitments are reflected in our booking and cancellation policies.

Expeditions are generally sold as complete packages. Guests are not automatically entitled to refunds for services they voluntarily choose not to use.

Guest cancellations are governed by Section 4, with replacement arrangements addressed in Section 5.

Services cancelled or not delivered by KAIJU or its providers will be assessed separately, subject to applicable law.

Working with independent providers does not remove KAIJU's own contractual or legal responsibilities toward guests.

Unless expressly included in the expedition itinerary, guests are responsible for additional expenses such as:

  • Flights and travel documentation.
  • Government taxes, park fees, and permits.
  • Personal meals, beverages, and purchases.
  • Optional activities and excess baggage.
  • Travel insurance and expenses outside the official expedition dates.

All inclusions and exclusions will be specified in the expedition details.

11. Photography, Media & Privacy

Photography and storytelling are part of the KAIJU experience.

Photos and videos may be captured for guest memories, documentation, and educational purposes.

KAIJU will seek appropriate consent before using identifiable guest images or videos for promotional or marketing purposes.

Guests may communicate their photography preferences before or during the expedition.

Personal Information

KAIJU S.A.S. collects and processes personal information necessary to organize and safely operate its expeditions, including contact details, booking information, travel documentation, insurance details, and relevant medical information.

Personal information will be processed only where an appropriate legal basis exists and in accordance with Ecuador's applicable data protection legislation.

Health information will receive additional protection, and any consent required for its processing will be obtained separately.

Information may be shared with local providers or international partners only where necessary and legally permitted, with appropriate safeguards for international data transfers.

Personal information will not be sold to advertisers.

12. Responsibility & Liability

KAIJU expeditions involve inherent risks associated with travel, outdoor activities, marine environments, wildlife, and remote locations.

Guests acknowledge these risks and agree to follow all safety instructions provided by KAIJU and authorized local guides.

KAIJU collaborates with independent local providers but remains responsible for its own contractual and legal obligations.

Responsibility for incidents, injuries, delays, losses, or damages will be determined according to the circumstances, contractual obligations, and applicable law.

These Terms & Conditions do not affect any legal rights or protections that guests are entitled to under applicable law.

Guests may be required to sign a separate participation and risk acknowledgment form before departure.

13. Wildlife & Environmental Responsibility

At KAIJU, the wellbeing of wildlife and the protection of natural environments always come first.

  • All guests must follow our ethical wildlife interaction guidelines and instructions from authorized local guides.
  • Wildlife must never be chased, touched, fed, baited, or intentionally disturbed.
  • Required distances and local regulations must always be respected.
  • Activities may be modified or stopped if an interaction could negatively affect wildlife or the environment.

Failure to respect these guidelines may result in restricted participation or removal from an activity, as described in Section 8.

14. Private Group Bookings

Private group expeditions may be booked under a single agreement with a designated group organizer or point of contact.

Unless otherwise agreed in writing:

  • The group organizer is responsible for coordinating participants, payments, and booking changes.
  • Pricing is based on the agreed group size, services, and arrangements.
  • If a participant withdraws, the total agreed group price does not automatically decrease.
  • The group organizer may propose a replacement participant, subject to KAIJU's approval and participation requirements.
  • Changes to group size, itinerary, or services may result in revised pricing or additional costs.

Specific payment and cancellation conditions for private groups will be communicated in the applicable booking agreement.

These provisions remain subject to applicable consumer protection laws.

15. Collaborative Expeditions & Partner Bookings

KAIJU Expeditions collaborates with other companies, organizations, and expedition leaders to create and host experiences.

Depending on the collaboration, booking arrangements, payment processing, and applicable Terms & Conditions may vary.

Bookings Managed by a Partner Company

  • When applications, reservations, and payments are managed directly by a collaborating company through its own platform, that company's booking, payment, cancellation, and refund policies will apply to those transactions.
  • Guests are responsible for reviewing and accepting the partner company's Terms & Conditions before confirming their reservation.

Bookings Managed by KAIJU Expeditions

  • When applications, reservations, and payments are managed directly by KAIJU Expeditions, KAIJU's Terms & Conditions, including its payment, cancellation, and refund policies, will apply unless otherwise agreed and disclosed in writing.

Shared Responsibilities

  • For collaborative expeditions, the company responsible for managing bookings and payments will be clearly identified before guests confirm their reservation.
  • Regardless of which company processes payments, each collaborating company remains responsible for its own services, conduct, and obligations under applicable law.
  • Any expedition-specific conditions or exceptions will be communicated to guests before booking confirmation.

16. General Provisions & Contact Information

KAIJU may update these Terms & Conditions as necessary. Changes take effect when published on our website. Confirmed bookings remain subject to their agreed terms unless changes are mutually accepted or legally required.

We make reasonable efforts to keep website information accurate and up to date.

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply.

These Terms & Conditions are governed by the laws of Ecuador, subject to any mandatory consumer protection laws and jurisdictional rules that may apply.
